Terms of Service
The rules for using Heku. They are few and written in plain language: if anything is unclear, write to us before accepting.
This is a courtesy translation. If the two versions differ, the Italian text prevails.
1. Who we are and what Heku is
Heku is a service of Samuele Cumani, Via Le Povere 22, 60044 Fabriano (AN), Italy (info@heku.dev), that lets you create websites and web apps by describing them in a chat to an assistant based on artificial intelligence models, watch them come to life in a preview, and publish them at a heku.dev address.
By using Heku you accept these terms and the privacy policy. If you do not accept them, do not use the service.
2. The service is in beta
Heku is in its beta phase: we are building it while you use it. This means that some features may change, disappear, or not work as expected, that the service may have interruptions, and that we do not guarantee continuous availability. We make daily backups, but we recommend that you export or keep elsewhere whatever is important to you.
3. Account
- The account is personal: you use it yourself, you do not transfer it, and you do not share it. You are responsible for whatever happens with your credentials; keep your password safe and notify us immediately at info@heku.dev if you think someone else is using it.
- You must be at least 16 years old and provide true information.
- You can close your account whenever you want by writing to info@heku.dev: we delete data, projects, and published sites within 30 days.
4. Credits
The assistant's work is paid for in credits. The rules are those on the Pricing page, which is authoritative for the numbers; here is how it works:
- Free plan: 5 credits per day, up to 30 per month, free of charge. Daily credits are valid for that same day.
- Pro plan (once payments are active): monthly credits based on the tier you choose, plus 5 credits per day. Prices include VAT.
- Usage-based: each message in Build mode charges credits in proportion to the AI work actually performed, with a minimum of 0.1 and never more than 5 credits per message. Plan mode and automatic error-repair attempts cost nothing. An interrupted or failed turn that delivers nothing costs nothing.
- Rollover: unused monthly credits carry over to the following month and expire 2 months after they are issued. Credits from one-time top-ups last 12 months.
- Credits are not money: they cannot be refunded, transferred, or converted into cash, except as provided by law for consumers.
5. The content you generate and publish
- The code, text, and images that Heku generates for you are yours: you can use, modify, export, and publish them wherever you want, including outside Heku.
- What you upload (logos, photos, text, screenshots) remains yours. You give us only the permission to use it to build and display your site. You must hold the rights to it: do not upload other people's material without permission.
- You are the one responsible for the sites you publish: for their content, for the data they collect through forms, for compliance with the law (privacy, commerce, third-party rights), and for the mandatory information owed to your visitors.
- The assistant can make mistakes: check text, numbers, and features before publishing. Do not entrust medical, legal, or financial decisions to a generated site without human oversight.
- We may take offline a published site that violates these terms or the law, notifying you when possible.
6. Prohibited uses
You may not use Heku for:
- creating or publishing content that is illegal, defamatory, violent, pornographic, or that incites hatred;
- phishing, scams, sites that impersonate others, malware, or collecting data by deception;
- infringing other people's copyrights, trademarks, or personal data;
- sending spam or unsolicited messages;
- circumventing credit limits, automating the use of the service, overloading it, or attempting to access other users' data and projects;
- copying or reselling Heku or parts of the platform.
7. Suspension and closure
If you violate these terms, we may suspend or close your account and take the sites involved offline, with advance notice when the situation allows. In serious cases (fraud, abuse, illegal content) we may do so immediately. If the account is closed for a violation, remaining credits are not refunded.
8. What remains ours
The Heku platform, its code, its name, and its logo are ours. These terms do not give you any right to them beyond the use of the service.
9. Limitation of liability
Heku is offered "as is," in beta. To the extent permitted by law, we are not liable for indirect damages, loss of data, loss of profit, or service interruptions, nor for content generated by the assistant or published by users. Our total liability to you is limited to the amount you paid us in the 12 months preceding the event (zero, if you use the free plan). Nothing in these terms limits the rights that the law grants to consumers.
10. Changes to these terms
We may update them when the service changes. We announce substantial changes by email or with a notice in the service; by continuing to use Heku after the notice, you accept them. The version and date at the bottom say which text is in force.
11. Governing law and jurisdiction
These terms are governed by Italian law. The Court of Ancona (Foro di Ancona) has jurisdiction over any dispute, except for the mandatory consumer forum provided for by law.
12. Contact
For questions about these terms, write to info@heku.dev.
